PLEASE READ THE FOLLOWING TERMS AND CONDITIONS (THE “TERMS”) VERY CAREFULLY, AS YOU ARE AVAILING THE RENT BE HALF FEATURE THROUGH THE PLATFORM (AS DEFINED IN THE TERMS OF USE OF THE PLATFORM) IS SUBJECT TO YOUR ACCEPTANCE OF, AND COMPLIANCE WITH THE FOLLOWING TERMS.
BY CLICKING ON THE "I AGREE" (OR A SIMILAR) BUTTON, YOU ACCEPT AND AGREE TO ALL OF THE TERMS AND CONDITIONS CONTAINED HEREIN. THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND THE COMPANY (AS DEFINED BELOW).
CAPITALIZED TERMS OTHER THAN THE ONES NOT DEFINED IN THESE TERMS, SHALL HAVE THE SAME MEANING ASCRIBED TO THEM IN THE TERMS OF USE OF THE PLATFORM.
IF YOU CONTINUE TO USE THIS PLATFORM, YOU ARE AGREEING TO BE BOUND BY THESE TERMS, WHICH ALONG WITH TERMS OF USE AND THE PRIVACY POLICY OF THE PLATFORM GOVERN YOUR RELATIONSHIP WITH US.
- SCOPE OF THE RENT BE HALF FEATURE:
- The Rent be half Feature (“Feature”), is applicable to the Product Lister who wishes to avail the Rental vertical of the Platform but are unable to create his/her own profile on the Platform for any reason whatsoever, authorise the Platform to list their Products on the Platform and allow the Platform to retain half of the rental received from Customers in consideration of Company services under this Feature. Rent be half is currently applicable only for those categories of Products that are currently supported under the End-to-End Facilitation Services. In this Feature, the Product Lister may approach the Company and authorize the Company to create the Product Lister’s profile on the Platform to carry out the listing of Products on the Product Lister profile. The Company shall after consulting the Product Lister, decide the rent, the rental period and the Security Deposit, manage the communication with Customers and coordinate the Orders for Rentals.
- The Product Lister understands that the Platform has the relevant experience and knowledge to ascertain the commercially viable rent for the Product and the Security Deposit amount and the Product Lister shall abide by the rent and Security Deposit amount proposed by the Company. The Company may, at its sole discretion, change the amounts with respect to rent and the Security Deposit at any time in order to encourage orders for the Product. Such a change would be intimated to the Product Lister via email
- The Product Lister shall confirm the detailed specifications of the Product, the rental amount and Security Deposit, periods for rental and availability of the Product by way of a physical consent form executed in favour of the Company (“Consent Form”).
- The Product Owner shall at all times be the owner of the Product and by availing this Feature, allows the Company to coordinate Rental for the Product and transfer the possession to the Customers during the Rental period.
- The Product Lister understands that the End-to-End Facilitation Services and Assurance Program shall be applicable to this Feature.
- REGISTRATION:
- SCOPE OF THE RENT BE HALF FEATURE:
- To avail this Rent be half feature provided through the Platform, You need to complete the registration process by accepting these Terms and the Consent Form. For such registration, You shall be required to provide the Company with the Personal Information and other information as specified in the Terms of Use for the Platform and authorize the Company to generate and operate the Product Lister’s profile accordingly.
- You understand and acknowledge that the manner in which the Personal Information is being collected or accessed by the Company has been exhaustively covered in our Privacy Policy and the Company shall not be responsible for authenticating the Personal Information submitted by You in connection with availing the Rent be half Feature on the Platform.
- In the event You wish to delete or update Your profile or delete or update any Products in the Profile, You may request the Company to do so by writing to support@ispick.com. The Company reserves the right in its sole discretion to accept/refuse/reject any update or deletion of Your profile/Product details without any obligation of explanation. Any ongoing rental period will have to be completed before the Product is delisted from the Profile.
- SCOPE OF THE RENT BE HALF FEATURE:
- LISTING OF PRODUCTS:
For listing the Products on the Platform under the Rent be half Feature post the Consent Form is provided, the information relating to such Products shall be communicated to the administrator of the Platform (“Administrator”) basis the Consent Form given by the Product Lister. The Administrator shall screen the Products and only those Products which, in the opinion of the Administrator, are suitable to be displayed on the Platform shall be uploaded by such Administrator. The Company shall be responsible for checking the quality of any Product offered by the Product Lister. Any such decision taken by the Administrator shall be final and binding upon the Product Listers who shall not dispute or question the same. Further, the Product Listers understand and acknowledge that the Customers and Users may report any listed Products to the Company for reasons including but not limited to, the inappropriateness of the Products and/or where the Products violate any applicable laws. Any decision taken by the Company with regard to such reported Products shall be final and binding upon the Product Listers, and the Product Listers shall not dispute or question such decision taken by the Company.
- PAYMENT:
- For this Feature, the Company shall deduct half of the Rental Order amount paid by the Customer (which includes total rent for the given duration and taxes applicable) before disbursing the rental amount to the Product Lister.
- The Product Listers understands that for Rental of Products under the Feature, the Security Deposit paid by the Customer renting out the Product(s) shall be retained by the Company for the entire rental term. The Security Deposit shall be refunded to the Customer after deduction of any damage claims settled under the Assurance Program.
- ORDER OF PRECEDENCE:
Should a conflict arise between these Terms and the Terms of Use of the Platform, these Terms shall prevail only to the extent of the subject matter herein.
